Push and Helical Piers

Epp Foundation Repair hereby warrants that the installed Push Piers/Helical Piers will stop further settlement of repaired areas for the lifetime of the

structure from the date of installation, or Epp Foundation Repair will provide the labor and materials, at no cost to the customer to repair, replace, or

adjust the Push Pier/Helical Pier. Any area of the structure, whether exterior or interior, that is not supported by Epp Foundation Repair installed Push

Piers/Helical Piers is specifically excluded from this limited warranty. Only Structures that are piered crack to crack, crack to corner or corner to

corner will be eligible for the warranty.

Heave or upward movement of the foundation due to soil expansion is excluded. This warranty does not include the cost for repair resulting from

consequential damages including but not limited to damage to concrete, brick, mortar, sheetrock, wallpaper, paint, rigid materials, or furnishings.

Vertical control benchmarks shall be established by Epp Foundation Repair after installation, and only those shall be used to determine any future

vertical movement.

The installation of the Push Piers/Helical Piers will not prevent damages caused by slope failure, soil creep, earthquake, flood, seismic events,

tornadoes, or other acts of God. The owner shall not hold Epp Foundation Repair responsible for direct damages or consequences of these damages

should they occur.

This warranty is not valid until full payment for work is collected.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are

no other verbal or written warranties.

Concrete Flatwork - 1 - Year Limited Warranty

Epp Foundation Repair, takes great pride in the concrete work we hope to provide for you. The relationship we establish between ourselves and our customers is one that we put great effort into. We follow all industry standards to achieve excellent and long-lasting concrete flatwork on the inside and outside of your home. Our ultimate goal is to satisfy you as a customer. The crews that will be working on your project are trained to pour and finish concrete to the highest of industry standards.

We also take great pride in our established relationships with our distributors and concrete suppliers. These relationships have allowed us to provide you with the highest quality materials. We offer a (1) year limited warranty on materials and workmanship for no additional cost. The following paragraphs detail our warranty, as well as what you can expect from your newly poured flatwork.

A. What You Can Expect from Your Concrete Flatwork Surfaces

Surfaces – One common misconception about the concrete that we pour for your driveway, porch or sidewalk surface, is that it will last and hold indefinitely. Unfortunately, that is not the case. Exterior concrete (particularly in Nebraska) is

subject to inclement weather and heavy vehicle traffic. This results in normal wear and tear on the surface of the concrete.

Although concrete is a very durable product, it is not without its flaws. Sometimes, there may be areas along the surface where there is minimal popping or flaking of the concrete. This is nothing to worry about, as the integrity of the slab is not compromised. However, if there is substantial popping/ flaking along the surface (more than 20%), this may fall under the

Epp Foundation Repair.

Cracks – Unfortunately, concrete will crack. Concrete is a strong and very rigid material. Concrete floors are poured over a large area (i.e. floors and driveways, etc.) of softer material (sand or gravel). Since these materials are not alike, we

design the concrete to compensate for this difference by cutting or forming control joints in the surface of the slab. These control joints are places that we have designed the concrete to crack. This can be done in one of two ways.

  • Seaming – This is the act of creating a seam in the newly poured uncured concrete with a hand tool prior to trowel finishing the surface.
  • Saw Cutting – This is the act of saw cutting a control joint into the hardened concrete slab between 12 and 24 hours after the concrete is poured. Sometimes, however, cracks occur before the joints are cut.

We do everything we can to control cracking, but there is no guarantee that the concrete won’t crack in other locations

later on.

** Epp Foundation Repair’s warranty covers cracks that are greater than 1⁄4 of an inch in height or gap. A crack that is less than 1⁄4 of an inch (height or gap) does not fall under our warranty.

Cracking and Frost Heave – Nebraska is in a severe weather region. During any given winter, there are many freeze-thaw cycles. During these times, your exterior concrete is likely to heave up. However, over time, it will most likely

settle back to its normal elevation again but there’s no guarantee that this will be the case 100% of the time.

Unfortunately, the slab is at risk of cracking during a frost heave event.** Cracking that is related to frost heave does not fall under the Epp Foundation Repair warranty.

Shifting & Settling – It is not uncommon for most driveways, sidewalks and garage floors to have some shifting overtime. Do not be concerned if you notice that your driveway or garage floor has moved a little or sounds hollow — this is nothing to worry about — especially if there are no cracks present.

** This does not fall under the Epp Foundation Repair warranty.

If your home has a patio or service walk, it is possible that it may settle. When we poured the concrete, we compacted the surface deep below the slab. However, this is no guarantee that the concrete will not settle.

** Epp Foundation Repair does not warranty against settling, because the sub-grade (below the surface) is out of our control.

Discoloration – Another common misconception is the color matching of concrete. It is not possible to match the exact color of your porch to your sidewalk or to your driveway. Sometimes, even the different pours within your driveway will not match exactly (most driveways require two or more loads of concrete, even these will vary in color). Most color variations are very minor and will fade over time.

If you are considering replacing one or two squares of your driveway or sidewalk, please take into consideration the color difference that will result between the old and new sections. This color variation will take years to blend together.

Items placed on top of concrete surfaces for an extended period of time (door mats, planters, benches, etc.) could cause discoloration once removed. Placing items on concrete limits the exposure to the elements and will cause the concrete to age differently.

** Concrete discoloration does not fall under the Epp Foundation Repair warranty.

Finishes – Interior concrete floor surfaces (basement and garages) are finished smooth. This will allow for easy maintenance. Please be aware that smooth finishes can be very slick when moistened. Exterior concrete (driveways,

stoops, patios & sidewalks) are broom finished. The broom surface is designed to be walked on, even when wet.

B. The Ins and Outs of the Epp Foundation Repair Warranty

Cracked Concrete

  • The Epp Foundation Repair warranty for cracking coincides with the industry standard. Only cracks greater than 1/4 of an inch (height or gap) may be warrantied.

Flaked or Popped Concrete

  • Epp Foundation Repair may repair a section of flaked or popped concrete IF more than 20% of the total area is affected (this is per industry standard).
  • Epp Foundation Repair DOES NOT warranty a popped or flaked driveway approach. The driveway approach area is subject to salt overspray during the winter months, which is out of our control.

General Warranty Matters

  • At any time, the decision to repair or replace concrete will be determined by Epp Foundation Repair management. 
  • The use of any salt or deicing chemicals will void warranty.
  • Warranty issues will be addressed during the months of June, July and August. If we are unable to service you during this time, we will service the following year.
  • For your warranty to be validated, Epp Foundation Repair must be contacted before your warranty expires.
  • Initial installation of concrete must be paid in full before any warranty issue will be resolved.

C. Dispute Resolution

In the event that there is a disagreement between Epp Foundation Repair and the Customer about the work covered by warranty, it is agreed that a third-party arbitrator will be contacted to resolve any difference. The cost for arbitration will be equally divided among each involved party. It is also understood that the arbitrated ruling is binding, and supersedes the
right to litigation, and the right to participate in a class action or similar proceeding.

D. Care of the Concrete

  • Do not drive on new concrete for at least 9 days.
  • Do not walk on new concrete for at least 3 days.
  • Keep pets and children away from new concrete until it hardens. If wet concrete comes in contact with bare skin it could cause serious harm. If concrete does come in contact with bare skin, rinse it off immediately with cool or room temperature water for at least 15 minutes.
  • Do not allow water to drain beneath the concrete, as settlement cracks may develop.
  • Keep the driveway completely shoveled off during the first winter (this reduces the risk of cracking).
  • Do not apply salt the first winter (as an alternative option, sand can be used for traction).
  • Apply a good concrete sealer.
  • Do not use harsh acids for stain removal.

Steel I-Beam Wall Brace - Lifetime Warranty

Epp Foundation Repair hereby warrants that the Steel I-Beam Wall Brace will stop further inward movement of the wall(s) repaired for the life of the
structure from the date of installation, or the contractor will provide the labor and materials at no cost to the customer to correct the problem.

Walls that are not anchored from corner to corner by contractor are not warranted. The Steel I-Beam Wall Brace is warranted only to stabilize the
affected wall(s) and not straighten them. Horizontal benchmarks shall be established by Epp Foundation Repair after installation, and only those shall
be used to determine any future horizontal movement.

The installation of the Steel I-Beam Wall Brace will not prevent damages caused by settlement, slope failure, soil creep, earthquake, flood, seismic
events, tornadoes, or other acts of God. The owner shall not hold Epp Foundation Repair responsible for direct damages or consequences of these
damages should they occur.

This warranty is not valid until full payment for work is collected.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are
no other verbal or written warranties.

Carbon Fiber System - Lifetime Warranty

Carbon Fiber Wall Supports are warranted in the area installed for the lifetime of the structure, from date of original installation. Carbon Fiber warranty
covers the foundation wall against any further inward movement in areas the Carbon Fiber is installed. If Carbon Fiber fails, materials and labor will
be replaced at no charge. Terms and conditions apply.

Carbon Fiber warranty for a bowed wall is only covered for walls bowed up to 3 inches. Walls that are not anchored from corner to corner by contractor are not warranted. Carbon Fiber Wall Supports are warranted only to stabilize the affected wall(s) and not straighten them. Horizontal benchmarks shall be established by Epp Foundation Repair after installation, and only those shall be used to determine any future horizontal movement.

The installation of the Carbon Fiber will not prevent damages caused by settlement, slope failure, soil creep, earthquake, flood, seismic events,
tornadoes or other acts of God. The owner shall not hold Epp Foundation Repair responsible for direct damages or consequences of these damages
should they occur.

This warranty is not valid until full payment for work is collected. This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are no other verbal or written warranties.

Interior Drain Tile - Lifetime Warranty

Epp Foundation Repair warrants all interior drainage systems free of defects in material and workmanship under normal use and service from groundwater
leakage in the installed areas for the lifetime of the structure from the date of original installation.

This warranty only applies to Interior Drain-tile systems which include: drain-tile, vapor barrier, and a sump pump & sump pit. Any system not
including all three of the aforementioned components, will only fall under the 25-year Interior Drain-Tile Warranty. The warranty contained herein
shall not apply to condensation or seepage from floor cracks, seepage through the foundation wall (Unless a vapor barrier was installed) or any system that
has been repaired by a party other than Epp Foundation Repair or has been altered in any way. This warranty does NOT cover cracking of replaced
concrete, backing up or blockage of sewer lines, gutters and downspout lines, floor drains, door jams and seal plates, discharge lines, floods, condensation
caused by high humidity, and or Drain Tile installed by anyone other than Epp Foundation Repair.

Epp Foundation Repair’s liability under this warranty shall be limited to the replacement within the aforesaid time of any defective work or material, and Epp Foundation Repair shall be liable for no other damages or losses.

Sump Pump and or mechanical components are under component manufacturer’s warranty, and are not considered part of this warranty. Epp
Foundation Repair can only be responsible for areas specifically treated by the work performed.

Epp Foundation Repair DOES NOT guarantee our drain tile system to be Radon safe and compatible with all pre and post installed systems.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are no
other verbal or written warranties.

Foundation Crack Repair/Pipe Penetration - 2-Year Warranty

Epp Foundation Repair hereby warrants the Crack Repair / Pipe Penetration for 2 years to be free from defects in material. The warranty states that no water shall seep through the Crack Repair / Pipe Penetration and collect on the floor from the area fixed. In such case that the Crack Repair / Pipe Penetration would fail, Epp Foundation Repair shall fix the area that is defective and leaking with whatever fix they feel suitable to stop the water.

Epp Foundation Repair is not responsible for contents damaged by system failure but only responsible for the repair of the area that was originally fixed.

This warranty is null and void if Epp Foundation Repair determines that there is settlement or bowing of the walls causing further wall movement, causing the Crack Repair / Pipe Penetration to reopen.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation
Repair. There are no other verbal or written warranties.

PolyLift® Concrete Lifting - 5-Year Warranty

Bronze: Epp Foundation Repair warrants that slabs raised with PolyLift® Bronze Package for a period of (5) years from the original date of installation. If the slab raised does settle during the 5-year time frame more than one half of an inch, Epp Concrete will re-lift providing all labor and materials to re-lift the area at no additional charge to Customer. If any cracking of the concrete should
occur during installation, Epp Foundation Repair will grind out crack and apply sealant at no additional cost to Customer. Epp Foundation Repair does not represent that PolyLift® will raise the Customer’s slab to meet any criteria of levelness, but instead that it will lift the slab as much as practical.

Silver: Epp Foundation Repair warrants that slabs raised with PolyLift® Silver Package for a period of (5) years from the original date of installation. If the area raised does settle during the 5-year time frame more than one half of an inch and/or the sealant does not stay intact, Epp Concrete will repair the area at no additional charge to Customer. If any cracking of the concrete should occur
during installation, Epp Foundation Repair will grind out crack and apply sealant at no additional cost to Customer.

Joint and Crack Sealant: Epp Foundation Repair warrants all Joint/Crack Sealants, for (1) year from the original installation date, the sealant will remain intact. In the event the Sealant does not remain intact, Epp will provide all labor and materials to re-seal the area at no additional charge to Customer.

Epp Foundation Repair’s PolyLift® procedure is intended to raise settling concrete slabs vertically, but depending on site conditions and other variables there is no guarantee this will be achievable 100% of the time. PolyLifting will never shift concrete walks, stoops, patios, or stairs in a horizontal manner. Upon arrival, Epp Foundation Repair’s PolyLift® technician will determine port
placement on concrete being lifted in a manner that will offer a chance at the most optimal results. During the lift procedure, the technician will monitor vertical movement as well as try to achieve positive drainage off of concrete being raised as long as such results are possible. If at any time anything other than the intended lift area starts to raise Epp Foundation Repair will cease
Polyurethane injection and focus on void filling affected area. Epp Foundation Repair is not liable for any damages that may occur as a result during the attempt to raise the concrete.

There will be a $75 service fee for the PolyLift® truck to return for any reason not covered under this Warranty. This Warranty is void if Customer does not: maintain backfill along the slabs of concrete to higher then the bottom of the concrete involved and seal joints and crack on the slabs lifted, or if re-settling occurs as a result of flooding, improper drainage (soil grade, downspouts,
etc.), if dumpsters or heavy equipment is placed on concrete, or other acts of God.

This warranty is not valid until full payment for work is collected.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are no other verbal or written warranties.

Egress Window - 5-Year Warranty

Contractor warrants that for 5 years from the original date of installation of the Egress Window System, Contractor will replace at its expense any failed or
defective egress window installed by Contractor which is caused by Contractors workmanship.

Contractor does not warrant that the window or window well is waterproof, and customer understands that while the risk is minimal, egress windows can
leak. Contractor will also not cover damages caused by a leaking window and/or window well.

This warranty is not valid until full payment for work is collected.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are no
other verbal or written warranties.

Slab Pier - 10-Year Warranty

Epp Foundation Repair hereby warrants that the installed Slab Piers will stop further settlement of repaired areas for 10 years from the date of
installation, or Epp Foundation Repair will provide the labor and materials at no cost to the customer to repair, replace, or adjust the Slab Piers. Any
area of the slab, whether exterior or interior, that is not supported by Epp Foundation Repair installed Slab Piers is specifically excluded from this
limited warranty.

Heave or upward movement of the slab due to soil expansion is excluded. This warranty does not include the cost for repair resulting from
consequential damages including but not limited to damage to concrete, brick, mortar, sheetrock, wallpaper, paint, rigid materials, or furnishings.

Vertical control benchmarks shall be established by Epp Foundation Repair after installation, and only those shall be used to determine any future
vertical movement.

The installation of the Slab Piers will not prevent damages caused by slope failure, soil creep, earthquake, flood, seismic events, tornadoes, or other
acts of God. The owner shall not hold Epp Foundation Repair responsible for direct damages or consequences of these damages should they occur.

This warranty is not valid until full payment for work is collected.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are
no other verbal or written warranties.

Wall Plate Anchor/C-Channel Wall Anchor - Lifetime Warranty

Epp Foundation Repair hereby warrants that the Wall Plate Anchor/C-Channel Wall Anchors will stop further inward movement of the wall(s) repaired
for the lifetime of the structure from the date of installation, or the contractor will provide the labor and materials at no cost to the customer to correct
the problem.

Walls that are not anchored from corner to corner by contractor are not warranted. Wall Plate Anchors/C-Channel Wall Anchors are warranted only to
stabilize the affected wall(s) and not straighten them. Horizontal benchmarks shall be established by Epp Foundation Repair after installation, and
only those shall be used to determine any future horizontal movement.

If customer desires further outward movement in wall(s) repaired, customer may tighten the installed wall anchors as recommended by the
manufacturer but assume all liability for damages due to over tightening the anchors.

The installation of the Wall Plate Anchors/C-Channel Wall Anchors will not prevent damages caused by settlement, slope failure, soil creep,
earthquake, flood, seismic events, tornadoes or other acts of God. The owner shall not hold Epp Foundation Repair responsible for direct damages or
consequences of these damages should they occur.

This warranty is not valid until full payment for work is collected.

This warranty is made in lieu of all other warranties, obligations or liabilities expressed and/or implied on behalf of Epp Foundation Repair. There are
no other verbal or written warranties.
